Mike said he likes to take a break, after 5 years or so the band will come back stronger than ever.
When everyone else refused to take the break, he said "ok then I need to quite. I don't feel connected to DT anymore !"
John P did try to convince Mike to stay. The band said that he is doing a huge mistake and the AX7 gig is like a affair and one day he will be overtaken by the reality
Around 8 weeks later, after AX7 and Mike separate ways, Mike has send an Email to DT asking for rejoining, which the band refuses (They had already selected MM and where wondering how in 8 weeks the passion for DT did came back)

The interviewer (Metal Hammer) is asking:
"So to take revenge Mike is now suing you for a lot of money, claiming share of ownership of the band's name"
James: It is correct that there are some legal issues which we need to sort out. Fact is that Mike took a lawyer and we have informed ours. We are are not allowed to share more"
John P: at the end theses are some private issues which we should not talk about in public. Fact is we the band own Dream Theater's name/brand

Interviewer: It must be a real torture as musician to have to deal with these kind of issues:
James: the times of friendship with Mike, when we where friends and would hug each other and wishing him success for the future are definitively over. He needs to clarify everything via the lawyer now, there no other way. It is unpleasant but he did decide to take this path and now the judges will have sort things out "
John: I don't see a massive issue/deal. These things are part of life, no matter if you are a cookie seller or musician

With regards to the new album:
The Interviewer: "The situation for James did not significantly changed. His demand to have more involved in the lyrics was not approved"
James: Well, for this album, I have submitted 3 lyrics but for some reasons only one was picked up. You never know, maybe the other two will be reconsidered next time

From Rock Hard:

When Huge Syme did create the art work for the album, the working title was "Bridges in the Sky" !!
Later it was changed to "A dramatic turn of events" and the original title which came from the song "The Shaman's Trance" was used to rename the actual song !

I love Portnoy and I do what I can to defend him and then this happens. I really tried to blow off the A7X thing. Then the whole trying to get back in the band was one thing. This is now really crossing the line. *Shaking my head*

No, that was completely different. Gaahl and King fired only remaining founding member of the band, Infernus. Since Infernus was the last founding member, the court decided that King's copyright was invalid, thus Infernus was able to keep the rights to the name and continue the band himself.

And side from Mike quitting the band on his own accord there are still two founding members left in Dream Theater, so I don't think there's anything he can do about it. :lol:

No. But it is the same as Tracii Guns and L.A. Guns and Ozzy and Sabbath in the sense that the suing party has no actual legal grounds to do so.

Mike is very quickly going from one of the most respected musicians in the business to one of the biggest jokes.

"As this question seems to come up every few weeks, I may as well go on the record," Portnoy replied.

"I have no idea why [DREAM THEATER guitarist John Petrucci] would have said [in a recent interview that] Ytsejam Records wouldn't be affected [by my exit from the group]...

"I was the one that handpicked and decided on every title, compiled the music and videos for the CDs and DVDs and oversaw the artwork and liner notes.

"John's side of the Ytsejam Records production team consisted of dealing with the manufacturing factory and staying on top of the payments and deliveries after I produced all of the titles...

"Being I have the entire 25-year archive of every studio and live recording from 1985 to 2010 in my home, and being the band currently refuse to answer my e-mails or calls, I honestly can't see any upcoming releases...

"It's a shame, too....I was already working on another batch before all of this went down..."

**UPDATE**: Portnoy earlier today (Friday, February 25) posted the following message on his official forum:

"Ugh...I just saw that my post has now ended up on Blabbermouth as well as some DREAM THEATER news sites and Forums and I am now getting ripped to shreds...

"I was simply trying to address a fan question that seems to keep popping up about the future of Ytsejam Records...

"I was not at all 'bad-mouthing' the DREAM THEATER guys, nor was I whining, crying or complaining...and this was surely NOT meant to be some sort of 'press release!!!!'

"I simply wanted to set the record straight here on my personal forum....

"I have always had an open relationship with you fans and never BS'ed or gave the 'politically correct,' sugar-coated answer....I've always tried to be very upfront, open and in direct contact with mine and DREAM THEATER's fan base... Unfortunately, I guess I REALLY need to watch everything I say these days for fear of misinterpretation and I apologize if I cannot address certain areas dealing with DREAM THEATER past or future."

IMO this actually seems that Portnoy is being a little more reasonable if he came up w/ the Label name, has all of the live recordings they've ever done at his house and they aren't responding, I think that Portnoy might actually be more in the right for this...god forbid.

This was way back in the beginning of the year, and didn't have to do with the fact of what is going on now. That's about Ytsejam Records, the Demo/Live/Bootleg/ label he started. Not Dream Theater's original music and name, which is getting sued for.

I wouldn't call myself a prog nerd but I do really love DT, it eats at me that I've never seen them live, it eats at me even more that my 1st MP experience had to be w/ A7X last year.

Portnoy is the one who fucked up in the first place. He wanted DT to wait and go by his schedule. I have major respect for the rest of DT for not wanting to do that and continuing on without him. Hopefully the new album will be good that way Portnoy can feel even worse about leaving.

Maybe he'll decide to sue them for writing a good album without him to? I mean if he's already desperate enough to sue for name rights this soon after leaving then why wouldn't he try and do that?

Sigh... yes I've seen the DVD's. Sadly yes I am very aware I missed out. Adrenaline Mob is Sept. 6, its not much but I know there won't be a ton of people there so that's still something I suppose.

I will say though that when I did see him with Avenged Sevenfold he was good. It was pretty cool when he would break a drumstick they would throw him one from the side of the stage and somehow he would catch them.

Same here. Once on the Prog Nation tour because I wanted to see Opeth, and once opening for Maiden. Well, I like a few songs - I can appreciate the musicianship for sure, I just don't listen to them.

This whole split has been hilarious to follow. Wishing the band luck in the legal side of things..
